Temporary Restraining Orders (TROs)
When someone alleges that he or she has been a victim of domestic violence, a judge will issue a Temporary Restraining Order ("TRO"). This order will prevent contact between the alleged victim and offender. This means no contact by phone, mail, e-mail, etc. The alleged offender will not be able to go to the victim's home and may be restrained from seeing his or her children. There may also be a temporary order for child support.
Final Restraining Orders (FROs)
After a Temporary Restraining Order is in place, the court will schedule a trial within 10 days of the TRO.
At the final hearing, the plaintiff must prove the allegations contained in the
complaint by the lowest evidential standard, i.e., a preponderance of the
evidence.
After the hearing, the court can either find in the plaintiff's favor or dismiss the complaint based on a failure of proofs. If the complaint is dismissed, the case is over subject to the plaintiff's right of appeal, and all prior TROs are vacated. If the court finds that an act of domestic violence was committed, then it has broad discretion to enter a final restraining order ("FRO") granting an array of remedial relief.
