Our Spousal Support Practice
In New Jersey, an award of spousal support is not automatic, but may be ordered based on certain factors. The court will consider a number of factors when making a determination, such as the length of the marriage, the age and health of the parties, and the earning capacity of the parties, among other circumstances.
At our office, we work with clients at all stages of an alimony dispute, from the determination of temporary support during the pendency of a divorce (known as "pendente lite support") through post-judgment requests for enforcement or modification of existing orders. We handle all types of alimony proceedings, including requests for:
- Temporary alimony: a request for short-term alimony to allow the recipient to get on solid financial ground
- Permanent alimony: long term support in situations where the recipient is unlikely to be able to earn enough to maintain a standard of living
- Rehabilitative alimony: support that allows the recipient to maintain a certain standard of living while developing the education, skills or trade to become self-sufficient
